Terms and conditions
The rules for buying original paintings in this shop.
1. Introduction
- These terms govern the relationship between the seller named above and the buyer when buying paintings through this online shop.
- A buyer who is a consumer has the rights given by the Czech Civil Code (Act No. 89/2012 Coll.), in particular the right to withdraw from the contract and rights in respect of defects.
- These terms are available in Czech, Russian and English. In case of any discrepancy, the Czech version prevails.
2. The goods
- The seller offers original works of art. Every work is unique and exists only once.
- Colours in the photographs may differ slightly depending on your display. Dimensions are given in centimetres (height × width × depth).
- The seller offers their own works and works by other artists. Works by other artists are sold in the seller’s own name for the account of their authors, under commission contracts with them. The buyer always concludes the purchase contract with the seller named above, who is responsible for performing it.
3. Orders and the contract
- The buyer chooses a work and a delivery method and fills in their contact details. The order is sent with the button “Order with obligation to pay”.
- The contract is concluded when the order confirmation reaches the buyer’s e-mail.
- Once the order is sent, the work is reserved for the buyer for the period stated in the confirmation. If the payment does not arrive in time, the order lapses and the work returns to the offer.
4. Price and payment
- Prices are final. The delivery price is shown at checkout before the order is sent.
- Payment is made by bank transfer to the seller’s account with the order number as the variable symbol. The payment details and a QR code are in the order confirmation.
- The seller issues an invoice and sends it to the buyer after payment.
5. Delivery
- The seller usually ships the work within 3 working days of receiving payment, or prepares it for collection in person in Prague.
- The risk of damage passes to the buyer on receipt from the carrier. The buyer should check the parcel on receipt and record any damage to the packaging with the carrier.
6. Withdrawal from the contract
- A consumer may withdraw from a distance contract without giving a reason within 14 days of receiving the work. The procedure is described on the page Returns and withdrawal.
- The seller refunds the price, including the cheapest delivery option offered, within 14 days of the withdrawal, but not before receiving the work back or proof that it was sent.
- The buyer bears the cost of returning the work. It must be returned undamaged and carefully packed.
7. Defects
The buyer may claim a defect in the work within 24 months of receipt. Details are on the page Returns and withdrawal.
8. Personal data
The processing of personal data is described on the page Privacy.
